Terms of Service

These terms are the agreement between you and us when you use Pixeraa. By ticking the box to start a portrait, you accept them.

Who we are

Pixeraa is a trading name of CHICRESTEMPIRE LTD, a company registered in England and Wales under company number 17435313, with its registered office at 66 Paul Street, London, EC2A 4NA.

Who can use it

You must be 18 or over. You may start a portrait without an account, but you need one to buy credits, download a portrait or place a print order.

The photographs you upload

You confirm, each time you upload, that:

• the photographs are of you, or of an adult who has agreed to this and has read our Privacy Policy;
• you have the right to use them — that you took them, or the photographer has agreed;
• they are not of a child;
• they are not of a public figure you have no connection to, and not anyone else’s copyrighted work.

You keep every right you already had in your photographs. You give us permission to store and process them only to make your portrait and to run the service, and that permission ends when you delete them.

We may refuse or remove an upload, and close an account, where this has been broken. We check uploads automatically for quality, and a photograph that fails is rejected with the reason rather than being used anyway.

What you get, and what it costs

• Generating a portrait is free. A generation that fails is never charged for.
• Credits are spent automatically when a portrait finishes, if your balance covers it, and that portrait is then yours to download. Without enough credits you still see it, and can add credits to unlock it.
• Credits do not expire and have no cash value. They are not electronic money and cannot be transferred or exchanged for cash.
• Printed portraits are priced separately at checkout, in pounds sterling, including delivery to a UK address.

The portrait itself

You own the portrait we make for you and can use it as you like, including commercially.

It is made by an AI model, which means we cannot promise a specific result. It is an interpretation in the style you picked, not a photograph and not a likeness guaranteed to satisfy you. That is exactly why generating is free and unlimited: judge it before you spend anything on it. We do not promise that any particular style, or the service itself, will always be available.

Prints

Prints are produced by our UK print partners. Each file is prepared and pre-flight checked against the printer’s specifications before it is sent. Colours on a printed piece will differ slightly from a backlit screen — that is inherent to printing, not a fault.

Cancelling, and refunds

Because portraits are made to your order, some of the usual cancellation rights do not apply. What does apply — and what we will do if something is wrong — is set out in the Refund Policy, which forms part of these terms.

What you must not do

• Use the service to make sexual, hateful, harassing or deceptive imagery of anyone.
• Impersonate a real person, or make a portrait intended to mislead.
• Attempt to break, overload or work around the limits of the service.
• Resell access to the service itself.

If something goes wrong

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Your legal rights as a consumer under the Consumer Rights Act 2015 are not affected by anything here.

Subject to that, we are not liable for losses that were not foreseeable, for business losses, or for any loss caused by photographs you did not have the right to upload. Our total liability to you for any claim is limited to what you have paid us in the twelve months before it arose.

Ending it

You can close your account at any time. We can suspend or close an account that breaks these terms; where we do, we will tell you why, and refund any unspent credits unless the reason was fraud.

Changes

We may change these terms. If a change materially affects you we will tell you by email before it takes effect, and the date at the top will change.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
